Terms of Service

Draft for legal review. For customers in Russia the Public Offer (in Russian) applies; where they differ for a Russian customer, the Offer prevails.

Effective 25 October 2026. These Terms are a contract between [не задано: legalName] ("AACSearch", "we") and the organisation that creates an account ("Customer").

1. Business use only

AACSearch is offered to businesses. By accepting these Terms you confirm you act for a company, sole trader or other professional, not as a consumer. Consumer-protection withdrawal rights therefore do not apply.

2. The service

Hosted search indexes, search and recommendation APIs, an AI assistant, an operator console and an embeddable widget. Plans, limits and prices are on the Pricing page and form part of these Terms. The technical steps to sign up, correct input errors and accept these Terms are shown in the sign-up flow; these Terms can be saved or printed from this page (Art. 10(3) E-Commerce Directive).

3. Accounts

The Customer is responsible for its users, credentials and API keys. API keys must not be embedded in public client code; use short-lived session tokens for browser embeds.

4. Fees, renewal and cancellation

Paid plans are subscriptions that renew automatically at the end of each billing period until cancelled. You can cancel at any time in Billing → Cancel subscription; access continues until the end of the paid period. Price changes are announced by e-mail at least 14 days before they apply. Wallet credit is prepaid; unused credit is refundable on request. Overage is charged at the published rates where the plan allows it.

5. Acceptable use

Do not use the service to break the law, index content you have no right to, store illegal content, probe private networks, scrape without permission, circumvent quotas, or attempt to make the AI assistant produce unlawful or deceptive output. We may suspend traffic that endangers the service or others, and will tell you why (Art. 17 DSA). Report illegal content via Digital Services Act information.

6. Customer data

The Customer owns its data. We process personal data in it as a processor under the DPA, which is incorporated into these Terms. We do not use Customer data to train AI models.

7. Switching and data export (EU Data Act)

For customers in the EU, Chapter VI of Regulation (EU) 2023/2854 applies:

  • you may switch to another provider or to your own infrastructure, or export all your data, on at most two months' notice;
  • the transition period is up to 30 days; exportable data comprises indexed documents, schemas and settings, synonyms, rules, query logs and analytics within their retention period, in documented open formats (JSON, CSV) via the console and API;
  • after termination your data stays retrievable for at least 30 days, then is erased;
  • we do not charge a switching fee and keep data-egress costs within legal limits; for EU customers any switching charge is banned from 12 January 2027 (Data Act Art. 29).

8. AI assistant

Answers are generated from your indexed content and may be inaccurate; the assistant is labelled as AI to your end-users and you must not remove that label. See AI transparency.

9. Availability and support

We aim for high availability and announce planned maintenance on the status page. Support: support@aacsearch.com.

10. Liability

Neither party is liable for indirect or consequential damages. Our aggregate liability is limited to fees paid in the three months before the claim. Nothing limits liability that cannot be limited by law (intent, gross negligence, injury).

11. Term and termination

These Terms apply while you have an account. Either party may terminate for material breach not cured within 30 days. On termination section 7 applies.

12. Changes

We will post changes here with a new date and e-mail account owners about material changes at least 30 days in advance. If you object, you may terminate before the change takes effect.

13. Governing law

The law of Российская Федерация governs these Terms, without prejudice to mandatory provisions of the law of the Customer's country.
