Data Portability and Switching (EU Data Act)
Draft for legal review. Regulation (EU) 2023/2854, Chapter VI, applies to data processing services (including SaaS) since 12 September 2025. There is no micro- or small-enterprise exemption from Chapter VI switching duties: the SME relief in the Data Act applies to Chapter II (connected-product data), not to switching.
